In 2000-2001 there were 167,186 complaints to tribunals – an increase of 83% over the previous five years. Unfair dismissal remained the most common complaint.
The maximum award for unfair dismissal is a basic award (up to £7,500) plus maximum compensation of £52,600, increasing to £53,500 on 1st Feb 2003. Compensation relating to discrimination is unlimited.
Statutory redundancy week pay maximum is now set at £250 per week increasing to £260 from 1/2/03.
The cost of winning a case at tribunal is now considered to be £5,000.
Tribunals have trebled since 1990 and the cost to the taxpayer is nearly £52 Million per annum.
Most small company (SME) dispensations have now been removed and therefore faced with the same issues as better equipped larger companies.
